Nintendo Creators Program Ending, YouTube Shackles Taken Off

It looks like Nintendo have finally come around to the idea of fair use on YouTube.

The Nintendo Creators Program has been a polarising venture since it began. Previously, Nintendo wouldn’t allow monetisation for any kind of third-party footage of their games. Since the inception of the program back in 2015, creators have been able to monetise their videos but with the caveat that Nintendo will receive a cut of the ad money.

With the Nintendo Creators Program ending in December, Nintendo have shared more info for content creators about what this means, and it looks like good news. Creators will be free to monetise their Nintendo-centric content without a slice going to the company themselves. There are plenty of questions to be answered, though it looks like Nintendo are being less archaic than usual when it comes to new media.

There are some limitations, but stuff that ultimately just makes sense. Content creators will not be allowed to upload content that is non-transformative, so basically gameplay footage without any contextual information or input from the content creator. Similarly, creators can use trailer and promotional footage but cannot leak content or play pirated games. You will also be prohibited from claiming that you are affiliated with Nintendo in any way.

This news will no doubt be welcomed by all content creators. Speaking from experience, Nintendo have been known to copyright claim without prejudice in the past; they’ve struck us in the past for using just a few seconds of fair use footage. While the Nintendo Creators Program wasn’t without its flaws, it looks like it’s helped Nintendo to better understand the YouTube ecosystem.
